Fraser Trebilcock trial attorneys Gary C. Rogers and Shaina R. Reed have successfully defended their clients in the Ingham County Circuit Court by securing a jury verdict of no-cause of action after a nine-day trial.
The plaintiff was a pedestrian who crossed a five lane street outside of a crosswalk before dawn, but was not observed by the defendant driver, who was driving a commercial vehicle. Plaintiff sustained very significant injuries for which he continues to treat years after the accident. The plaintiff alleged the defendant driver was distracted, evidenced by the fact that the defendant driver's cell phone was ultimately located in the footwell of the driver's side compartment after the accident.
The plaintiff retained four experts - human factors/accident reconstruction and toxicology, and the defense retained three experts. The plaintiff requested that the jury award $6 million, but the jury found the defendant as not negligent.
