Fraser Trebilcock attorney Emily M. Vanderlaan was recently successful in obtaining summary disposition on behalf of the firm's client. The Fraser client had been sued under the theory they were negligent in the operation of their vehicle, leading to an accident in which Plaintiff allegedly sustained serious, life altering injuries. Plaintiff filed suit in the Circuit Courts seeking damages in excess of $25,000.
However, prior to trial, the Fraser team filed a motion for summary disposition, contending that the plaintiff did not sufficiently prove that they had sustained a serious impairment of body function that affected their general ability to live their normal life. Ms. Vanderlaan further argued at the hearing that the plaintiff had a longstanding history of pre-existing medical conditions that they were now trying to improperly attribute to the motor vehicle accident. The judge agreed, dismissing all of plaintiff’s claims against the Fraser client.
