Court Grants Motion to Dismiss Fraternity from Lawsuit

Fraser Trebilcock attorneys Gary Rogers and Ryan Kauffman successfully defended a lawsuit brought against a national fraternity in federal court. In the lawsuit, which had been filed in the United States District Court for the Western District of Michigan, the plaintiff, a college student, alleged that she was sexually assaulted by one member of the fraternity’ s local chapter. The plaintiff also brought claims under Title IX against Michigan State University for the manner in which the university handled the incident after it was reported. Gary and Ryan successfully argued that the fraternity was not responsible for the assault and did not owe a legal duty to the plaintiff to protect her from the alleged criminal act. The Court agreed and granted the motion to dismiss the fraternity from the lawsuit.
